An Introduction to Our Affiliate Referral Opportunity:

Brilliant Factory Members have the opportunity to earn money or other rewards by referring new members. Members can promote membership in Brilliant Factory to friends, family, and business associates, and be rewarded for these efforts when their qualified referrals result in a sale of a new Brilliant Factory Membership.

Details on our currently available referral program opportunities can be found on our Affiliate Program page. The current program is subject to the Member Affiliate Referral Program Terms described below.

Member Affiliate Referral Program Terms

These Affiliate Referral Program Terms ("Program Terms") are fully incorporated by reference into our Terms of Use and govern participation in the Brilliant Factory Affiliate Referral Program (the "Program") offered by Brilliant Factory, Inc. (the "Company," "Our," "Us," "We") to its Members ("Member," "Referrer," "You," "Your"). By participating in this Program, You agree to be bound by these Program Terms.

Eligibility

The Program is open to any Member with an active Account in good standing. This offer is currently valid only in the United States.

Good Standing

To be a Member in good standing, Your subscription payment must be current and You must not be in violation of Our Terms of Use.

Timing

The Program is currently available until further notice. We reserve the right to change or end the Program at any time at Our sole discretion.

Relationship

The nature of the relationship between the Company and You will be that of independent contractors for all purposes and in no event will You or any person employed by You be held or construed to be an employee of the Company. Brilliant Factory, Inc. is not a member of any partnership, joint venture or franchise arrangement with You. You are responsible to pay all federal, state, and local taxes associated with commissions paid to You pursuant to the Program.

Member ID Referral Code

When You join Brilliant Factory, You receive a Member ID that is Your Affiliate Referral code, which You can provide to friends, family, and business associates who You wish to refer to Brilliant Factory. We will also make referral links and banners available to You.

You may invite potential new members to join in person or in writing, or through other approved methods, including: direct emailing; via Your provided affiliate link or banner ads; blog mentions; or social postings. You must comply with the anti-spam terms herein.

Qualified Referral

A "Qualified Referral" is a person (the "Referred Customer") who arrives to Our Site by clicking Your provided affiliate link or banner ad, or by specifying Your Member ID during the process of joining and paying the subscription fee.

Qualified referrals who purchase a Membership will be recorded as having been referred by You for purposes of compensation.

The Referred Customer must meet the following eligibility requirements in order for You to earn a commission. To be eligible, the referred party: 1.) Must be of legal age and meet all eligibility requirements as described in the Terms of Use; 2.) Must be a U.S. citizen or resident; 3.) Cannot have previously joined Brilliant Factory; 4.) Must have paid the Mebership fee, and 5.) Cannot be Yourself (for example, You, but using a different email address, name, etc.). Further, We reserve the right to refuse any membership application at Our sole discretion.

No Spam

You must comply with all current Anti-Spam laws. Spam is defined as bulk distribution of unsolicited communications. Emails that contain the referral link must be created and distributed in a personal manner, and bulk email distribution is strongly discouraged.

Your use of Your Referral link within unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds to terminate Your Membership and Your participation in the Program.

Commissions

The Company agrees to pay You a commission or other reward for membership sales generated from Your Qualified Referrals. The Commission amount and compensation method will be per the affiliate commission plan currently in force on the date that the new Member purchases a subscription. Details and rules for earning commissions may change from time to time at Our sole discretion. See “Affiliate Program” on the Site for the most current commission plan information.

Commissions are paid after 60 days from the date of payment of the membership fee for a valid, eligible membership. We will not provide compensation for any referrals where the provision of any compensation for a referral is prohibited by law.

Commission payments will cease on the effective date of termination of Your Membership for any reason.

Publishers and Bloggers

Publishers of websites or blogs are encouraged to refer new Members via their sites. To be eligible for the Program, You must be a Member of Brilliant Factory in good standing, and then You may post any of Our approved ad banners, or the unique Affiliate link provided to you, on Your site or to social sites.

You are solely responsible for all content development (and its cost) on your web site or blog.

The provided link or banner ad may contain an incentive offer or discount to the potential Brilliant Factory member; the incentive or discount will not affect the amount of your referral commission. You may not alter the content of any banner ads or change the terms of the offer.

You may desire to disclose that You could potentially receive a commission from your affiliate participation, for example: "You can help us earn a commission to support this site by clicking on this link or display ad to join Brilliant Factory®."

Trademarks and Other Intellectual Property

You acknowledge that all rights in any registered trademarks or any pending trademark registrations associated with the business of the Company (i.e., trademarks, service marks, slogans, logos, designs and other similar means of distinction), including all goodwill pertaining thereto, shall be the sole property of the Company. You may use and display such trademarks only in the manner and for the purpose authorized by the Company, and subject to the Eligibility and Term of this Program. The Company reserves the right to add to, change, or discontinue the use of any trademark it owns, on a selective or general basis, at any time.

You shall not use any trademark or trade name of the Company in any corporate, partnership or business name without the Company's prior written consent. All other terms related to Intellectual Property set forth in the Terms of Use also apply to the Program.

Media and Publicity

No press releases mentioning Your Program participation may be made without prior written consent of the Company to a release being published. You will provide a copy of any such press releases to the Company in advance of publication. Conduct

You agree that you will adhere to the Company’s Terms of Use. You agree to conduct Yourself and your online mentions of the Company (including mentions of fellow Members) with due regard to public conventions and morals and agree that You will not commit any act that would tend to degrade the Company or bring it into public hatred, contempt, scorn, or ridicule, or that will tend to shock, insult or offend the community or ridicule public morals or decency. Further, You will not market the Company’s Site or products using illegal, unethical, or misleading methods, or through inaccurate content. Your use of Your Referral link or banner in a manner that is expressly prohibited or against the culture and norms communicated in Our Terms of Use will be grounds to terminate your Membership Account and Your participation in the Program.

Right to Terminate Accounts

We reserve the right to terminate the Membership Account and the associated Affiliate privileges of any Referrer or Referred Customer if the Referrer or Referred Customer attempts to use the Program in a questionable manner, or breaches any of these Program Terms, or is in violation of any law, statute or governmental regulation.

Any unpaid or pending commissions will be forfeited as of the date of the finding of wrongdoing, determined by Us in our sole discretion.

Upon termination of Your membership by You or the Company, for any reason, You agree to discontinue any use of the Brilliant Factory trademark(s), and any other related links, banners, or other materials in any manner and for any purpose.

Right to Change Terms

We reserve the right to change these Program Terms at any time at Our sole discretion.

Right to Cancel Program

We reserve the right to cancel the Program at any time at Our sole discretion.
